Out the two main classifications of crimes in Florida (misdemeanors and felonies), felonies are the more serious of the two. A Felony is any offense where the Court may sentence an individual to Florida State Prison (as opposed to county jail). There are three main classifications of felony charges:

TYPE OF FELONY MAXIMUM PENALTY
Third Degree Felony Five (5) years Florida State Prison
Second Degree Felony Fifteen (15) years Florida State Prison
First Degree Felony Thirty (30) years Florida State Prison

In Felony cases, the Court will use a “score sheet” which will determine the type of sentence of received. The “score sheet” is a function of the nature of the pending charge and an individual’s criminal history.

A great number of cases may be eligible for diversionary programs such as Pre-Trial Intervention or Drug Court which will result in dismissal upon successful completion. If these options are not available, our Felony Defense Attorneys will look for other ways to achieve dismissal of your Felony charges. Other alternatives may include probation. We will always seek to avoid a conviction (referred to as a “withholding of adjudication) being placed on your record and look for ways to preserve the possibility of a records expungement or sealing.
