Out the two main classifications of crimes in Florida, (misdemeanors and felonies), misdemeanors are the less serious of the two. A Misdemeanor is any offense where the Court may sentence an individual to county jail for up to one year (as opposed to Florida State Prison). There are two main classifications of misdemeanor charges:

Second Degree Misdemeanor Sixty (60) days County Jail
First Degree Misdemeanor Three Hundred and Sixty Four (364) days County Jail

A great number of cases may be eligible for diversionary programs such as the Misdemeanor Diversion Program or Drug Court which will result in dismissal upon successful completion. If these options are not available, our Misdemeanor Defense Lawyers will look for other ways to achieve dismissal of the charges. Other alternatives may include the payment of minimal court costs or probation. We will always seek to avoid a conviction being placed on our client’s record (referred to as a “withholding of adjudication”) and look for ways to preserve the possibility of a records expungement or sealing.
